Canyon County Pit Bulls Contract

 

The following agreement is between “Jean M., and Jara N. Brasseure”, hereafter referred to as “Seller” and

__________________________ hereafter referred to as “Buyer” for the sale and purchase of one ADBA and/or UKC registered Purebred American Pit Bull Terrier dog/puppy.

In consideration of a total purchase price of $_______________, there is a two hundred and fifty dollar NON-REFUNDABLE DEPOSIT to reserve said dog/puppy until 8 weeks of age, and is applied to the total purchase of said dog/puppy upon ownership transfer.

Show Quality Terms and Agreements

The said dog/puppy, if sold to the buyer as Show Quality, in the sellers opinion is suitable for exhibition in the conformation, obedience, agility or weight pull ring of the ADBA.  The seller guarantees that the said dog/puppy, at the time of sale, does not have any disqualifying faults as per the breed standard.  The said dog/puppy is by no means guaranteed to win in the exhibit ring every time it is shown.  The buyer is also required to exhibit the said dog/puppy in the ring at least twice per year.  The buyer is also required to attend at least a basic obedience class prior to exhibition of the said dog/puppy.

 

 

Brood Quality Terms and Agreements

The said dog/puppy, if sold to the buyer as Brood Quality, in the sellers opinion is suitable for exhibition in the conformation, obedience, agility or weight pull ring of the ADBA, however, the said dog/puppy is not required to be shown.  The said dog/puppy is suitable for reproductive purposes but is not guaranteed to be able to sire or whelp puppies.  See Breeding Requirements.  The buyer is also encouraged to attend a basic obedience class.

 

 

 

 

 

Pet Quality Terms and Agreements

The said dog/puppy, if sold to the buyer as Pet Quality, in the seller’s opinion, is not suitable for exhibition in the conformation ring, nor is said dog/puppy suitable for reproductive purposes.  The said dog/puppy is best suited as a family companion, or for performance events (i.e. obedience, weight pull, etc.).  The said dog/puppy is to never reproduce.  NO EXCEPTIONS!  The said dog/puppy MUST be neutered/spayed as soon as possible, not to exceed 6 months of age.  A copy of the neuter/spay certificate must be presented to the seller to receive ADBA registration papers for said dog/puppy.

Breeding requirements of Show and Brood Quality Dogs/Puppies

For Females: The said dog/puppy shall not be breed before she turns two, for the female’s best interest.  The buyer should keep in mind that the female should be allowed a resting period each year from being bred.  The seller also prefers the buyer to not breed the female more than five times in her life time, and strongly encourages the buyer to obtain health testing and temperament testing on the said dog/puppy prior to each breeding.  When selection a stud, he must be able to better the breed.  He must be UKC and/or ADBA registered.  DO NOT breed with a stud that is not registered.  DO NOT breed with a stud that is not in the standard or is vicious.  DO NOT breed with a different breed of dog.  

For Males: The said dog/puppy shall not be breed before he turns one.  The seller strongly encourages the buyer to obtain health testing and temperament testing on the said dog/puppy prior to each breeding.  The seller reserves the right to one free stud service to any female of the seller’s choice and the buyer agrees to sign the litter registration papers upon seller’s request.  When selection a dam, she must be able to better the breed.  She must be UKC and/or ADBA registered.  DO NOT breed with a dam that is not registered.  DO NOT breed with a dam that is not in the standard or is vicious.  DO NOT breed with a different breed of dog.  

 

 

 

 

The Buyer’s Commitment to the Seller

The seller and the buyer agree that the said dog/puppy is NOT purchased for resale, nor will it be used or trained for activities which are illegal/inhumane or for which the said dog/puppy is not suited for by reason of temperament or structure.  Specifically, it will NOT be used for commercial protection, or dog fighting or baiting purposes of any kind.  In the event of illegal/inhumane actions, legal action will be taken.  If buyer moves, buyer will have 7 days to update all information or said dog/puppy will be considered stolen, and buyer will be responsible for all legal fees.

The Seller’s Commitment to the Buyer

Right Of Recovery/Placement of Said Dog/Puppy

In the event that the buyer is unable to keep said dog/puppy, for any reason, or no longer wants the said dog/puppy, it shall be returned to the seller, at buyer’s expense, and any and all registration papers on the said dog/puppy will be signed over completely to the seller.  The buyer is NEVER to sell, give away, trade, abandon, or put down the said dog/puppy.

In the event that the buyer breaches this contract in anyway, shape or form and legal action must be taken, the buyer will assume all responsibility for any and all legal expenses that are incurred by the seller in the recovery of said dog/puppy, as well as the buyer’s own expenses.

NO RESALE POLICY

By signing this contract buyer also states the following:  If for any reason buyer cannot or does not wish to keep said dog/puppy, buyer will contact the seller. Buyer agrees to provide the seller the guaranteed right to take the said dog/puppy back without refunding of purchase price. Buyer does not under any circumstance have the right to sell said dog/puppy without the expressed and written consent of the seller. If buyer contacts the seller & seller chooses not to take the said dog/puppy back seller will give buyer written release to sell the said dog/puppy & will assist buyer in placing the said dog/puppy in a good home.

In the event that this contract is breached and the said dog/puppy is transferred to someone else, the said dog/puppy will be considered stolen.  The seller has the right to take the said dog/puppy back from the new owner with no compensation to the new owner.  Should Buyer violate this contract, Buyer shall be liable to Seller for $5,000.00 in liquidated damages, plus all attorney fees and costs incurred to achieve a remedy or get said dog/puppy back to seller. Any deletions or changes to this contract shall be lined out and initialed by seller and buyer, additional amendments will be noted on the back of this contract followed by the signature of seller and buyer.

Ear Cropping

If you wish to crop your puppies ears, there is only one crop allowed.  You may do a show crop.  NO fighting crops.  If you are not sure what crop will look best, please contact us and we will help you find an appropriate one.  If you would like ears to be cropped before the puppies is delivered to you, let us know so we can get it done.  All cropping is an extra $200.00.  Puppy, shipping (if needed) and ear cropping must be paid for by 7-8 weeks old.  A puppy that gets it’s ears cropped will be able to go home at about 10-12 weeks old or as soon as the vet gives the ok.

Option 1:  Pay full balance off included $250.00 non-refundable deposit. 

 

Option 2:  Pay $250.00 non-refundable deposit.  Pay off said dog/puppy in full at pick up at 7-8 weeks old.  As early as 6 weeks if local and 8-9 weeks if shipping.

 

Option 3:  Pay $250.00 non-refundable deposit.  Pay half of balance of said dog/puppy by 7-8 weeks old.  Pay off said dog/puppy by 10-11 weeks old.  Seller will hold said dog/puppy until paid in full for no extra charges.
